By completing a purchase, you explicitly acknowledge and agree that:

Your agreement is considered affirmative consent to these Terms at the time of checkout.
You waive the right to claim “unawareness” of store policies after purchase.

3. Product Condition & Descriptions

We sell primarily vintage, preloved, and/or secondhand goods.

You acknowledge and agree that:

Items may show signs of wear, aging, fading, or imperfections consistent with prior use.
All items are sold “as-is” unless explicitly stated otherwise.
Condition descriptions and photos are provided as accurately as reasonably possible, but minor variations may occur due to lighting, display, or device settings.

It is the buyer’s responsibility to review all listing details before purchase.

4. Pricing, Errors, and Order Acceptance

We reserve the right to:

Refuse, cancel, or limit any order at any time.
Correct pricing errors or listing inaccuracies without obligation.
Cancel orders suspected of fraud, abuse, or unauthorized activity.

An order is not considered accepted until it has been processed and shipped.

5. Payment Authorization

By placing an order, you authorize us and our payment processors to charge your selected payment method for the full amount of your purchase, including shipping and applicable taxes.

You agree that:

You are the authorized user of the payment method used.
You will not initiate a chargeback without first contacting us to resolve any issue.

6. No Return / All Sales Final Policy

All sales are final. We do not accept returns, refunds, exchanges, or cancellations once an order is placed.

By purchasing, you expressly agree that:

You are buying the item in its described condition.
You waive any right to return the item for change of mind, fit, or expectation differences.

Exceptions (if any) are strictly limited to:

Incorrect item received
Item significantly not as described (as determined by us upon review)

Any claim must be submitted within 3 days of delivery with supporting photo evidence.

7. Shipping & Risk of Loss

Once an order is transferred to the shipping carrier:

Title and risk of loss pass to the buyer.
We are not responsible for delays, lost, stolen, or misdelivered packages.

Tracking information provided by the carrier is considered valid proof of delivery.

8. Chargebacks & Payment Disputes

By completing a purchase, you agree that:

You will not initiate a chargeback or payment dispute without first contacting us and allowing a reasonable opportunity to resolve the issue.
All valid disputes must follow our documented policies.
Unauthorized chargebacks will be treated as fraudulent activity and may result in:
- Submission of order evidence to the payment processor (including checkout logs, IP address, shipping confirmation, tracking, and policy acceptance records)
- Permanent ban from future purchases
- Debt recovery action where applicable

We reserve the right to contest all chargebacks with full supporting documentation.

9. Intellectual Property

All content on this website, including images, branding, logos, and text, is the exclusive property of Backwater Vintage Co and may not be copied, reproduced, or reused without written permission.

10. Limitation of Liability

To the fullest extent permitted by law, Backwater Vintage Co shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or products.

Our total liability for any claim shall not exceed the amount paid for the product in question.

11. Indemnification

You agree to indemnify and hold harmless Backwater Vintage Co, its owners, employees, and affiliates from any claims, damages, or expenses resulting from your violation of these Terms.
